These Terms and Conditions govern the use of the website and services provided by Ian Herd Wildlife & Nature Photography (referred to as "we", "us" or "Ian Herd"). By accessing or using our website, purchasing prints, downloads or services, or contacting us, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our website or services.

A non-refundable deposit is required at the time of booking.
(2.1) The remaining balance is payable 28 days prior to the workshop date unless otherwise stated. If full payment is not received by the stipulated date, Ian Herd reserves the right to assume the booking as cancelled and retain the deposit.
(2.2) If the booking is made within 28 days of the workshop date, the full amount shall be payable at the time the booking is made.

By booking through the website, you agree to all Terms & Conditions listed. A reservation is confirmed once full payment is received. I will then confirm your booking via email.

Ian Herd reserves the right to make amendments to the itinerary of any workshop. The participant(s) should understand that a reasonable amount of flexibility will be required with the itinerary. A workshop description is an indication of what is likely to take place, and is not a contractual obligation to provide the exact details of the description.
In the event that an amendment significantly alters the itinerary of a workshop, the Participant will be notified and offered a choice of;
(4.1) accepting the amendment.
(4.2) booking a place on an alternative workshop, any overpayment will be refunded.
(4.3) withdrawing from the contract and accepting a full refund of any money paid.

Should you decide to cancel your workshop with us, for any reason, you will forfeit the non-refundable deposit.
(5.1) If the participant requests to cancel the workshop at least 14 days before the workshop date, then the participant is entitled to a 50% refund.
(5.2) If the workshop is cancelled by the participant within 14 days of the workshop date, then the participant is not entitled to a refund.
(5.3) The participant must make any cancellations in writing by Email to; Ianherdphotography@gmail.com
(5.4) In the event that the workshop has to be cancelled due to adverse weather, the participant will be offered to rebook the workshop for a different date, or book a different workshop of same value.
(5.5) If the trip is postponed or cancelled by the boat operators, and we are unable to re-schedule the trip, the cost of the boat trip(s) will be refunded to you in full.
(5.6) No refunds will be given for late arrivals or no shows, if you are delayed for whatever reason, please let us know ASAP.

The participant should understand that all wildlife workshops involve working with wild animals & birds, outside of the captive environment, and therefore an amount of flexibility and understanding is required. Ian Herd cannot be held responsible for the absence or “no show” of animals or birds, nor cloudy or poor weather on workshops.

Ian Herd does not accept any responsibility for the loss of, or damage of any items or personal effects, such as clothing, money and equipment, photographic or otherwise, owned by the participant, nor does Ian Herd accept any liability for any loss or additional expense caused to the participant. Any such loses are solely the responsiblity of the participant.

The participant confirms that they are medically and physically fit to take part in the workshop. Ian Herd reserves the right to refuse participation where health or fitness poses a risk.
You should assume a reasonable amount of walking is required, which might also include broken or rough terrain, unless otherwise stated. You are responsible for ensuring you are fit to take part in outdoor activities.

Ian Herd does not accept any liability for death, physical injury, illness or any other harm caused to the participant.

(10.1) The participant agrees to keep wildlife workshop locations confidential in order to protect the wildlife from unnecessary pressure.
(10.2) The participant is not permitted to disclose locations visited on their workshop, this includes mentioning locations on social media.
(10.3) The participant agrees not to return to the locations visited on their workshop(s) for the purpose of promoting their own workshops and/or tours.

Participants must follow all safety instructions given by your guide to ensure your own safety, and the safety of others on the workshops.
All participants are required to behave in a safe and acceptable manner, and not disrupt the enjoyment of others on the workshops. Behaviour that is not tolerated could lead to your Immediate removal from the workshop.
Ian Herd reserves the right to stop any workshop, if he feels that the behaviour of the participant is, or could have, a negative impact on the wildlife or nature. In this situation no refunds or future workshops will be offered to the participant.

By paying for the workshop the participant agrees to all of the above Terms and Conditions.

This contract is governed by Scottish law and the jurisdiction of the Scottish courts.

Wildlife photography guides must abide by strict environmental regulations. Complaints often arise when a guide causes "intentional or reckless" disturbance to protected species.
(14.1) Legal complaints regarding wildlife photography guides generally hinge on wildlife protection laws (specifically regarding disturbance) and contractual obligations/professional negligence.
(14.2) Summary of Best Practices
Welfare First: A guide must always put the welfare of the animal before the photo.
Licensing: Photographers (and their guides) must have a licence to photograph protected species, which should be checked before starting the workshop.
Evidence: Document the guide’s actions (times, locations, specific instructions given) if you suspect a violation, and report it to the relevant authority.
